TICK is an online platform designed to connect watch collectors, buyers and independent watch dealers.

The platform allows users to discover watch dealers and watches, create accounts, save content, submit enquiries, leave reviews and use other features that we may introduce from time to time.

TICK provides the platform through which dealers and users can connect. Unless expressly stated otherwise, TICK does not own, inspect, authenticate, sell or supply watches listed by dealers on the platform.

Any purchase, sale, part-exchange, valuation or other transaction subsequently agreed between a user and a dealer is between those parties directly.

You must be at least 18 years old to create an account or use features of TICK that involve contacting dealers, submitting reviews or entering into transactions.

By creating an account, you confirm that the information you provide is accurate and that you are legally capable of agreeing to these Terms.

Certain features of TICK require you to create an account.

You are responsible for:

• providing accurate and current information;
• keeping your login details secure;
• activity carried out through your account; and
• notifying us if you believe your account has been accessed without permission.

You must not create an account using false information, impersonate another person or business, or use another person’s account without permission.

We may suspend or remove accounts that breach these Terms or where we reasonably believe an account is being used fraudulently, unlawfully or in a way that could harm TICK or its users.

Collector accounts may allow users to browse and save watches, save dealers, submit enquiries, leave reviews and access other collector features made available by TICK.

Features available to collectors may change as the platform develops.

Unless clearly stated otherwise, creating a collector account is free.

Dealer profiles and watch listings are created or supplied by independent third-party dealers.

Dealers are responsible for ensuring that information they publish through TICK is accurate, lawful and not misleading.

This includes information relating to:

• watches;
• prices;
• availability;
• condition;
• provenance;
• authenticity;
• servicing history;
• warranties;
• business information; and
• photographs or other media.

The presence of a dealer or watch on TICK does not automatically constitute an endorsement, guarantee or certification by TICK.

Dealers using TICK are also subject to our separate Dealer Terms, where applicable.

Watch listings are provided for informational and discovery purposes.

Availability, pricing and other details may change and a watch displayed on TICK may already have been reserved or sold.

Users should confirm all relevant information directly with the dealer before agreeing to purchase a watch.

TICK does not independently guarantee the authenticity, condition, ownership, provenance, value or description of any watch listed on the platform.

TICK allows users to contact dealers regarding watches or other services.

Submitting an enquiry does not create a contract for the purchase or sale of a watch.

Any subsequent agreement or transaction is made directly between the user and dealer.

Before completing a transaction, users should carry out any checks they consider appropriate regarding the watch, dealer, payment method, delivery arrangements and terms of sale.

TICK is not a party to transactions between users and dealers and does not hold or transfer funds for watch purchases unless explicitly stated otherwise.

TICK may allow users to leave reviews about dealers.

Reviews should reflect genuine experiences and must not contain content that is knowingly false, misleading, defamatory, abusive, discriminatory, threatening, unlawful or otherwise inappropriate.

Users must not submit reviews in exchange for payment, incentives or other benefits where doing so would make the review misleading.

Dealers must not create false reviews, arrange for false reviews to be submitted or attempt to manipulate their rating.

We reserve the right to investigate, moderate or remove reviews where we reasonably believe they breach these Terms or our Reviews & Acceptable Use Policy.

We do not guarantee that every review published on TICK has been independently verified.

You may be able to submit content to TICK, including reviews, profile information, enquiries and other material.

You retain ownership of content that you create.

By submitting content to TICK, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and use that content where reasonably necessary to operate, promote and improve the platform.

You confirm that you have the right to submit the content and that doing so does not infringe the rights of another person or organisation.

You must not use TICK to:

• commit or facilitate fraud;
• impersonate another person or organisation;
• submit deliberately false or misleading information;
• harass, threaten or abuse another user or dealer;
• distribute malware or other harmful material;
• attempt to gain unauthorised access to TICK or another user’s account;
• scrape, harvest or systematically extract platform data without permission;
• interfere with the operation or security of the platform;
• infringe intellectual property or other legal rights;
• send unsolicited or inappropriate commercial messages; or
• use TICK for any unlawful purpose.

We may restrict or terminate access where we reasonably believe these rules have been breached.

Unless otherwise stated, the TICK name, branding, website design, software, written content and other materials created by TICK are owned by or licensed to us.

Dealer names, logos, watch photographs and other dealer-supplied materials remain the property of their respective owners or licensors.

You may use TICK for personal and legitimate business purposes associated with the platform.

You may not reproduce, republish, sell, commercially exploit or systematically extract TICK content without our prior permission, except where permitted by law.

TICK may contain links to dealer websites, social media profiles, payment providers and other third-party services.

These services are operated independently from TICK.

We are not responsible for the availability, security, content, privacy practices or actions of third-party websites or services.

Your use of a third-party service may be subject to that provider’s own terms and policies.

We aim to keep TICK available and functioning reliably, but we cannot guarantee uninterrupted or error-free access.

We may temporarily restrict access for maintenance, security, updates or circumstances outside our reasonable control.

Features may also be added, changed or removed as TICK develops.

We may suspend, restrict or terminate an account where we reasonably believe:

• these Terms have been breached;
• the account presents a security or fraud risk;
• the platform is being misused;
• continued access could cause harm to another user, dealer or TICK; or
• we are required to do so by law.

Where appropriate, we may provide an opportunity to resolve an issue before taking action.

Users may stop using TICK at any time and may request account deletion subject to any information we are legally required or reasonably entitled to retain.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

TICK acts primarily as a platform connecting independent dealers and users.

To the extent permitted by law, we are not responsible for losses arising solely from:

• inaccurate information supplied by a dealer or other user;
• the condition, authenticity, provenance or availability of a watch supplied by a dealer;
• transactions agreed directly between users and dealers;
• the actions or omissions of independent dealers;
• third-party websites or services; or
• circumstances outside our reasonable control.

Nothing in these Terms affects any statutory rights you may have as a consumer.

Your privacy is important to us.

Our Privacy Policy explains how we collect, use, store and protect personal information when you use TICK.

Our Cookie Policy explains how cookies and similar technologies are used on the website.

We may update these Terms where necessary to reflect changes to TICK, our services, applicable law or how the platform operates.

The latest version will be published on TICK with the date it was last updated.

Where a change materially affects registered users, we may also provide additional notice where appropriate.

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from mandatory protections provided by the laws applicable where you live.

Any disputes will be subject to the jurisdiction of the courts applicable under relevant law.
